The short version

Buy a scooter that is legal where you’ll ride it — in most states that means locked to 25 km/h (WA: also 25 kg or less). NSW still doesn’t allow private e-scooters in public, and the NT only allows 200 W / 10 km/h. Ask which safety standard it meets, check who will service it, and keep the receipt and serial. General information, not legal advice.

Most scooters sold online go much faster than the law allows. Before you look at range or looks, check the device limits for your state:

  • QLD: the device must be limited to 25 km/h; riders need to be 16+ with at least a learner licence (supervised exemptions for 12–17-year-olds). Older scooters must be limited by 28 February 2027 — buying new, ask the shop to show you the limit is set.
  • WA: 25 km/h và 25 kg or less — many big dual-motor scooters are over the weight limit.
  • NSW: private e-scooters aren’t legal on roads, paths or footpaths (only on private property). Don’t buy one expecting to commute.
  • NT: only low-powered (200 W, 10 km/h) devices.

2. Make sure the speed limit is built in, not “unlockable”

Ads that say “unlock 45 km/h” or “speed mode” are a warning sign. A scooter ridden above your state’s limit isn’t legal in public, and insurers can refuse claims on modified scooters — see e-scooter insurance. Ask the seller: what is the top speed as delivered, and can it be limited to 25 km/h?

3. Look for the safety marks (and ask which standard)

  • NSW: since 1 February 2026 e-scooters supplied in NSW must be certified and carry a safety approval mark — separately on the scooter, the battery and the charger, on the product itself (not only the box), and on every website listing it. Accepted standards include AS/NZS 60335.2.114:2023, EN 17128:2020 and UL 2272 (UL 2272:2016 only until 1 February 2027). • Các tiểu bang khác: no certification-before-sale scheme yet. Victoria’s regulator consulted on one in 2025 and says it is “monitoring action nationally” before deciding (Energy Safe Victoria, reviewed February 2026).
  • Wherever you live, ask the seller which standard the scooter, battery and charger meet, and only use the charger it came with. See e-scooter battery safety.

4. Check the weight, size and tyres for your trip

Think about where you’ll carry it: up stairs, onto a train or bus (rules differ — see e-scooters on public transport), into a car boot. Air-filled tyres ride smoother but can puncture; solid tyres don’t puncture but ride harder. Ask about the rider weight limit and whether tyres and tubes are easy to get.

5. Find out who will service it

Tyres, brakes and bearings wear, and batteries age. Before you buy, check there’s a workshop near you that works on that brand (sửa xe scooter điện) and that spare parts are sold in Australia. A local shop that sells it can usually service it too. Typical costs: e-scooter repair costs.

6. Know your consumer rights (and who you’re buying from)

New scooters bought from a business come with the Australian Consumer Law guarantees — repair, replacement or refund for a major fault. An overseas business that sells directly to Australians must follow the ACL too, but the ACCC says it “can be difficult to get a repair, replacement or refund from an overseas business”. Look for visible contact details and an ABN, keep emails, the receipt and the product description, and pay with a method that lets you dispute the charge. Source: ACCC, “Buying online”.

7. In Queensland, age checks apply at the counter

It’s illegal in Queensland to sell an e-scooter (or e-bike) to anyone under 16 — including private sales — and shops must check age and display under-16 signs. Expect to show ID. Source: Queensland Government, “Rules for selling e-mobility devices”.

8. Record it the day you get it

Write down the serial number (where to find it), photograph the scooter and the serial, keep the receipt — and add them to a free Hộ chiếu Xe scooter điện. If it’s ever stolen you have what police and insurers ask for, and when you sell it buyers can see it’s yours.

Câu hỏi thường gặp

Do I need to register a new e-scooter in Australia?

No state requires registration for a legal e-scooter. A free E-scooter Passport is optional and records the serial, photos and proof of ownership.

Can I buy a 40+ km/h scooter and just ride it slower?

In states with a 25 km/h device limit the scooter itself must be limited, so a faster scooter isn’t legal to ride in public even if you ride it slowly. Check the model with the legal check.

Is it legal to buy an e-scooter in NSW?

You can buy one, but private e-scooters can’t be ridden on NSW roads, paths or footpaths — only on private property. Scooters sold in NSW must carry the safety approval mark.

Is buying from an overseas website a problem?

If the business sells directly to Australians the Australian Consumer Law applies, but getting a repair or refund from overseas can be hard, parts and servicing may be hard to find, and the scooter may not meet your state’s speed or weight limit.
